When filing for bankruptcy you are under no obligation to hire an attorney, but it is always a good idea to do so. If you try to face up to this predicament alone, you may find it is the worst decision you have ever made in your life.

Since the Bankruptcy Abuse Prevention and Consumer Protection Act passed in 2005, filing for bankruptcy has become a real legal maze. It is easy to make mistakes and incur in penalties when you are not familiar with all the legal hurdles, this may also cost you a denial of your filing.

It is the attorney’s job to help you achieve financial assistance and pull you out from your predicament, by finding a suitable strategy and choosing the best Chapter under which to file your bankruptcy. You may find attorneys specializing in personal or corporate bankruptcies. In general, the latter type will be filed under Chapters 9 and 11, while the former are filed under Chapters 7 and 13. However, this may vary and it is up to your attorney to decide the best strategy to implement.
